REGARDING:  Your inquiry for information concerning a Power of Attorney.

Thank you for your request for more information about your choices for a power of attorney.  On Page Two, Frequently Asked Questions (FAQs), I have included an overview about the purpose and function of a Power of Attorney.  Please note, this response is directed to RESIDENTS OF CALIFORNIA. 

Basically, there are three options:

  1. An attorney drafted document to meet any special needs;
  2. A generic, supposedly valid in all 50 states, form from a local big-box, office supply store; or
  3. A Durable Statutory Power of Attorney form.

In certain instances, you may need a specially-drafted Power of Attorney.  Perhaps you are traveling to Europe for the summer and want to give someone a limited power to care for the house and car for those two months.  Perhaps you want your business partner to have a power to deal with business issues, but your adult children to deal with personal finances.  There are many reasons for a specialized power of attorney.  Expect to pay $300 per hour for consultation and drafting time.

Next you can purchase a form from the store.  As an attorney with over a decade of estate planning experience, I strongly do not endorse this  option.  State law is very specific and varied from state to state.  You should only use documents drafted for your state.  Besides, the form is probably more expensive than the Durable Statutory Power of Attorney you can purchase here for $9.97.

This brings us to the very popular option of using a Durable Statutory Power of Attorney form.  The form available here as a PDF download meets the requirements of the California Probate Code and also importantly meets the requirements of new law changes (California Civil Code) for the Notary Acknowledgement effective January 1, 2008. I have included the current Acknowledgment form if you want to sign the document before January 1, 2007.  Therefore is no need to wait, purchase a Durable Statutory Power of Attorney now and you will be able to download it in a matter of minutes.
